Terms Of Service
From the team at Rainbow Curriculum, thank you for using our product! We build it to help schools plan their curriculum with less stress and more clarity. We're a small company, just two people, so we can't know every customer personally, but we want to be upfront about how things work. These Terms of Service help us do that.
When we say "Company", "we", "our", or "us" in this document, we are referring to Mike Glavin Catalyst Limited (Company number 12880359), registered at Hillview Cottage, Llangybi, Usk, Gwent, United Kingdom, NP15 1NN.
When we say "Service", we mean the Rainbow Curriculum application, whether accessed through a web browser or any other format we may offer in the future.
When we say "You" or "your", we are referring to the school, organisation, or individual that holds an account with our Service.
We may update these Terms in the future. Whenever we make a significant change, we will refresh the date at the top of this page and notify account holders by email. When you use our Service, now or in the future, you are agreeing to the latest Terms. These Terms do contain a limitation of our liability.
If you violate any of the Terms, we may terminate your account. That's a broad statement and it means you need to place a lot of trust in us. We do our best to deserve that trust by being straightforward about how we run things and keeping an open door to your feedback.
Account Terms
- You are responsible for maintaining the security of your account and password and for ensuring that any of your users do the same. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
- You are responsible for all content posted to and activity that occurs under your account, including content posted by and activity of any users in your account.
- You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
Payment and Billing
- Rainbow Curriculum is offered on annual plans. Payment is made via purchase order and invoicing.
- We may offer free demonstration accounts for a limited period. When a demo period ends, you will need to move to a paid plan to continue using the Service. If you do not, we will freeze your account until payment is arranged.
- All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. Where required, we will collect those taxes on behalf of the taxing authority. Otherwise, you are responsible for payment of all applicable taxes.
- If you believe you have been incorrectly charged, get in touch with us and we will work it out. We're reasonable people.
Cancellation and Termination
- You are solely responsible for properly cancelling your account. You can do this by contacting us directly. If you need help, just email us.
- All of your content will be inaccessible from the Service immediately upon cancellation. Within 30 days, all content will be permanently deleted from active systems. Within 60 days, all content will be permanently deleted from our backups. We cannot recover this information once it has been permanently deleted.
- If you cancel before the end of your current paid-up period, your cancellation will take effect at the end of that period and you will not be charged again.
- We have the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time. We hope we never have to use this clause, but it is there for the rare case where someone is doing something genuinely harmful.
- Verbal, physical, written, or other abuse (including threats) of a Company employee will result in immediate account termination.
Changes to the Service and Prices
- We are always working to improve Rainbow Curriculum. That means we may add, change, or remove features from time to time. We reserve the right to modify or discontinue, temporarily or permanently, any part of the Service with or without notice.
- Sometimes we may change our pricing. If we do, we will give at least 30 days' notice and will notify you via the email address on your account. We will always try to be fair about this. We are not in the business of surprising people.
Uptime and Security
- Your use of the Service is at your sole risk. We provide the Service on an "as is" and "as available" basis. We do not offer a formal service-level agreement, but we take uptime seriously and do our best to keep things running smoothly.
- We take many measures to protect and secure your data through backups, redundancies, and encryption. We enforce encryption for data transmission from the public internet. We are Cyber Essentials certified.
- Your data is hosted within the EU and UK.
- When you use our Service, you entrust us with your data. We take that trust to heart. We process your data only for the purpose of providing the Service to you, as described in these Terms and our Privacy Policy. We may access your data in the following limited circumstances:
- To help you with support requests you make. We will ask for your consent before accessing your account data.
- When an error occurs that needs manual investigation. We aim to fix the root cause to prevent recurrence.
- To safeguard the Service. We may review logs and metadata to ensure the security of your data and the Service as a whole.
- To the extent required by applicable law.
- We use third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
Curriculum Planning: Your Responsibility
This is important, so we want to be clear about it:
- Rainbow Curriculum is a planning tool. We are not curriculum advisors, education consultants, or regulatory experts. We do not provide curriculum advice or recommendations.
- We do not guarantee that use of our Service will ensure compliance with the National Curriculum for Wales, the National Curriculum for England, or any other national or local education standards, frameworks, or statutory requirements.
- Your school is solely responsible for its own curriculum decisions, including the content, structure, and delivery of your curriculum. Any curriculum plans created using the Service are your own work, and you are responsible for ensuring they meet the requirements of your inspectorate (such as Estyn or Ofsted) and any other relevant bodies.
- We may include reference materials, templates, or frameworks within the Service to help you get started, but these are provided for convenience only and should not be treated as authoritative or complete.
Features and Bugs
We design Rainbow Curriculum with care, based on our own experience and the feedback of schools who share their time with us. However, there is no such thing as software that pleases everybody. We make no guarantees that our Service will meet your specific requirements or expectations. We also test our features extensively before shipping them. As with any software, there will inevitably be some bugs. We track the bugs reported to us and work through priority ones, especially any related to security or data integrity. Not all reported bugs will get fixed and we don't guarantee completely error-free software.
Liability
You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Service; (ii) the cost of procurement of substitute goods and services; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Service; (v) any curriculum decisions, plans, or outcomes arising from your use of the Service; (vi) any failure to meet regulatory, inspection, or statutory education requirements; or (vii) any other matter relating to these Terms or the Service, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
In other words: choosing to use our Service does mean you are making a bet on us. If the bet does not work out, that's on you, not us. We do our best to be as safe a bet as possible through careful management of the business, investments in security and infrastructure, and in general giving a damn. If you choose to use our Service, thank you for betting on us.
Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.
